Nelson’s term expired on June 30, 2007. The council voted against reappointing her at its July and August meetings that year.
In May 2007 three council members — Bev Fisher, who is no longer on the council, and current members Don Hutzell and Tracy Merfeld — filed a lawsuit against Nelson and then-mayor J.R. Ackley over issues related to placement of a veterans monument in town.
They dropped the lawsuit the following month but tension remained at council meetings over the matter.
In September 2007 Nelson withdrew her name from consideration for the Park Board. In December, Ackley again asked that she be reappointed. The council tabled the motion.
In January, a motion was made to add Nelson’s appointment to the agenda, but the new mayor, Doug Merfeld, declared it out of order.
In September, the issue resurfaced when council members asked if anyone had requested that Nelson’s appointment be put on the February agenda.
City Attorney Mark Walk said Ackley’s recommendation from December was dead if no one made the request.
At Monday’s meeting, Councilman Max Handley said he had a copy of an e-mail he sent to Merfeld on Jan. 29 requesting Nelson’s appointment be put on the February meeting agenda.
Merfeld said he wanted to bring in a mediator but Handley said mediation would cost the city “another $150 an hour we don’t have.”
He suggested a compromise in which the council would approve Nelson’s appointment and the city would pay $863 in attorney fees Merfeld owed for consulting a lawyer on city issues before Walk was appointed.
“Not acceptable,” Merfeld said. He asked Handley if he was willing to spend $863 of city money to get Nelson back on the Park Board.
Handley said he didn’t like the idea but was willing to do it to have the issue settled.
Merfeld said he would agree to appoint Nelson and have the city pay the legal bill if the council agreed to appoint Kris Kuykendall to another vacant seat on the Park Board.
The council voted 5-0 to appoint Nelson and Kuykendall and to pay the legal fee.
